Inner Mongolia Autonomous Region Milk Management Regulations

Chapter 1 General Provisions

Article 1 These regulations are formulated in order to strengthen the management of fresh milk, ensure the quality of fresh milk, protect the health of consumers, promote the production of fresh milk in the autonomous region and the development of the dairy industry, and in accordance with relevant national laws and regulations and the actual conditions of the autonomous region.

Article 2 Units and individuals engaged in the production, purchase, operation, and processing of fresh milk in the autonomous regions must abide by these regulations.

Article 3 Fresh milk in this regulation refers to unprocessed milk.

Article 4 The autonomous region encourages the development of dairy farming. Governments at all levels should give preferential treatment in funding, grassland use, feed supply, etc. to support the development of dairy farming.

Units and individuals of dairy cows should improve the breeding methods and improve the yield and quality of fresh milk through improved varieties.

Article 5 Dairy production enterprises shall establish a stable and cooperative relationship with fresh milk production units and individuals and sign contracts to clarify the rights and obligations of both parties. Unions can also be formed on a voluntary basis.

Article 6 The regulations shall be organized and implemented by the centralized management departments of the dairy industry and the livestock husbandry management department at all levels.

Chapter II Quality Management

Article 7 Each coalition or municipality may formulate local standards for the acquisition of fresh milk in accordance with the national milk purchase standard and the actual conditions in the region, and report it to the standardization administration of the autonomous region for approval and implementation.

Article 8 The quality indicators of fresh milk, such as sensory, physical and chemical, and hygiene, must comply with the National Standard for the Acquisition of Fresh Milk and Local Standards.

Article 9 Fresh milk shall not be mixed with water and other substances.

Article 10 prohibits the sale and purchase of the following abnormal milk:

(a) suffering from mastitis;

(b) Within 15 days before calving and within 7 days after calving;

(c) during the period of treatment with antimicrobial agents and within five days after discontinuation;

(4) suffering from legal infectious diseases such as brucellosis;

(5) The color has changed and smells.

Chapter III Purchase and Sales Management

Article 11 The League Administrative Office and the Municipal People's Government shall, in accordance with the scale and benefits of dairy industrial enterprises, reasonably define or adjust the scope of milk purchases by enterprises.

Within the scope of demarcated milk purchases, dairy companies must protect the interests of fresh milk producers, make timely acquisitions, and cash their milk in accordance with the contract.

Article 12 The price of fresh milk shall be set by the price department of the League City in conjunction with the centralized management department of the local dairy industry in accordance with the local standards for the procurement of fresh milk and the principle of high quality and preferential prices.

Article 13 The milk purchaser shall purchase milk at the purchase price of fresh milk in the region, and shall not use any name to reduce the price or raise the price, and shall not purchase milk beyond the scope of purchase of milk.

Chapter IV Quality Supervision and Inspection

Article 14 The milk purchaser must be equipped with a fresh milk quality inspector. Fresh milk quality inspectors are responsible for training by the City Technical Supervision Department and are issued with a quality inspection certificate for fresh milk after passing the assessment. The fresh milk quality inspector holds a card inspection. Fresh milk quality inspectors are guided by the local technical supervision department.

Article 15 Duties of fresh milk quality inspectors:

(1) Check the quality of fresh milk in accordance with relevant standards and quality inspection procedures;

(2) It is recommended that the purchaser refuse to acquire milk if it is adulterated by milk;

(3) Fresh milk mixed with toxic and hazardous substances shall be detained locally and submitted to the technical supervision department for disposal;

(d) Assist the technical supervision department in supervising the quality of fresh milk.

Article 16 The banner and county technical supervision department and the food hygiene supervision department shall supervise and inspect the quality and hygiene of fresh milk. The dispute over the quality of fresh milk between the acquisition unit and the producer is decided by the technical supervision department.

Chapter V Punishment

Article 17 Where the purchase of milk exceeds the scope of purchase of milk, the administrative department for industry and commerce at the county level shall order it to stop the purchase and shall impose a fine not exceeding the total value of the collected milk.

Article 18 Where a person purchases milk by himself at a price that is not subject to price reduction or price increase, the price department shall impose a fine of not more than 200 yuan on the person directly liable, and he shall propose to the unit to be given administrative sanctions.

Article 19 Where any one of the following acts is violated in violation of these Provisions, the county-level technical supervision department shall impose an administrative penalty; if the circumstances are serious enough to constitute a crime, the judicial organ shall investigate the criminal liability according to law:

(1) Incorporating non-toxic and harmful substances into fresh milk shall be punishable by a fine of 10 to 30 times the value of milk equivalent to that of adulterated milk;

(2) Incorporating toxic and hazardous substances into fresh milk shall be confiscated and a fine of not more than 100 times the value of fresh milk equal to adulterated milk shall be imposed;

(3) For the sale of fresh milk as prescribed in Article 10 of these Provisions, the product shall be confiscated and the person directly liable shall be imposed a fine of not more than 500 yuan.

Article 20 For unreasonable victims, assaulting administrative law enforcement personnel, milk purchasers, fresh milk quality inspectors, and destructive inspections of sun-lifting and milking facilities, the public security department shall punish them in accordance with the Regulations of the People's Republic of China on Public Security Administration Punishment; this constitutes a crime. , investigate criminal responsibility according to law.

Article 21 Where administrative law enforcement personnel, milk purchasers, fresh milk quality inspectors afflict dairy households, engage in malpractice for personal gains, demand bribery, receive bribery, and abuse their powers, their units shall, depending on the circumstances, impose administrative sanctions; Be held criminally responsible.

Article 22 If a dairy industrial enterprise refuses to make an unprovoked purchase within the scope of the designated milk purchase or if it fails to purchase fresh milk on time and causes economic losses to the dairy farmer, it shall be compensated.

Chapter VI Supplementary Provisions

Article 23 The supply of fresh milk for urban residents and other food processing shall be implemented with reference to these regulations.

Article 24 The specific issues in the implementation of this provision shall be interpreted by the Autonomous Region Light Industry Department.

Article 25 These regulations shall come into force as of the date of promulgation.
