The necessity of revising the “Regulations” The original “Regulations of the People's Republic of China on Water Transport Management” (hereinafter referred to as the “Regulations”) was implemented in 1987, reflecting the development characteristics and management requirements of China’s water transport market at the beginning of reform and opening up. The development of the domestic water transport market has played an important role. However, there are also problems that cannot meet the requirements of economic and social development and the new requirements for the construction of the rule of law. First, many of the provisions of the original “Regulations” have a strong planned economy, which limits the market’s ability to exercise its regulatory role in resource allocation; second, the original “Regulations”. There are many administrative licensing items set up, the licensing conditions are not clear, the procedures are relatively complicated, and the types and ranges of administrative penalties are not reasonably set. They do not meet the requirements of the Administrative Permit Law and the Administrative Punishment Law and the requirements of law enforcement practice; The original "Regulations" lacked a complete market supervision system; Fourth, the original "Regulations" basically did not cover water transport safety management, energy conservation and emission reduction, and capacity control. In the new era, the development of water transportation faces new situations and new requirements.
